These Terms and Conditions (the “Terms”) govern your passage into and engagement with the digital atelier of LUNIERE ATELIER through our websites and platforms (“Site”). By entering this curated space, you affirm your acceptance of these Terms and enter into a binding agreement with the Maison. If you cannot honor these Terms, you are invited to refrain from accessing the Site.

References to “you” and “your” denote the visitor or user of this atelier. References to “Maison,” “we,” or “our” signify LUNIERE ATELIER in its entirety — the stewards of sound, vision, and artistry. These Terms exist to safeguard not merely the intellectual property and creative works of the Maison, but to uphold the elegance, dignity, and refined expression that define our ethos.

I. THE MAISON’S DIGITAL ATELIER
This Site serves as a sanctum of creation — a space in which sound, vision, and word converge under the exacting standards of artistic cultivation. All content (“Maison Materials”) is presented for personal contemplation, educational insight, and aesthetic appreciation. Any engagement beyond these parameters—commercial use, public distribution, or derivative exploitation—requires prior written authorization from the Maison.

II. INTELLECTUAL PROPERTY & MAISON RIGHTS

All Maison Materials — including compositions, recordings, written content, visual assets, typographic designs, logos, and digital elements — are either the exclusive property of the Maison or used under valid license agreements. Use of these materials beyond the scope permitted herein is strictly prohibited.

No express or implied license is granted for any use beyond personal, non-commercial viewing.

Attempts to replicate, adapt, distribute, publicly perform, or commercially exploit Maison Materials without written consent are considered direct infringement and may result in legal proceedings, including claims for injunctive relief, damages, and attorney fees.

Any assertion of authorship, ownership, or rights to Maison Materials by unauthorized parties is strictly forbidden.

III. PERMITTED USES
Users may engage with Maison Materials solely for:
    •    Personal contemplation and private viewing;
    •    Artistic inspiration and critique, provided it does not involve replication or public dissemination;
    •    Educational reference, respecting the copyright and moral rights of the Maison.

IV. PROHIBITED CONDUCT
In acknowledgment of the sanctity of this digital atelier, you shall never:
    0.    Circumvent technical protections, security measures, or access controls;
    0.    Scrape, mine, or systematically extract Maison Materials for personal or commercial purposes;
    0.    Impersonate the Maison, its collaborators, or Artists;
    0.    Interfere with the technical operation of the Site or the Maison’s digital infrastructure;
    0.    Engage in any activity that harasses, intimidates, or diminishes the dignity of Artists, Maison personnel, or collaborators;
    0.    Misappropriate or unlawfully exploit the Maison’s intellectual property in any manner.

V. DIGNITY, ETIQUETTE, AND ARTIST PROTECTION
LUNIERE ATELIER regards the dignity and creative sovereignty of all Artists as inviolable. Users shall not:
    •    Disseminate defamatory, harassing, coercive, or threatening communications targeting Artists;
    •    Solicit or manipulate Artists for personal, commercial, or unlawful gain;
    •    Interfere with the professional or creative processes of Artists;
    •    Engage in actions violating civil, criminal, or digital conduct statutes with respect to the Maison or its representatives.
Violations may prompt immediate restriction or termination of access, reporting to authorities, and the pursuit of all available legal remedies.

VI. ACCURACY, SITE INTEGRITY, AND MODIFICATIONS
    0.    While the Maison endeavors to present its digital atelier with precision and elegance, the Site and Maison Materials are provided without guarantees of uninterrupted access, absolute accuracy, or perpetual currency.
    0.    The Maison retains the right to modify, suspend, or remove any content at any time without notice or liability.
    0.    Users are responsible for independently verifying any information and assume all risk associated with reliance on the Site.

VII. DISCLAIMERS OF WARRANTIES
The Maison provides the Site and Maison Materials “as is” and “as available”, disavowing all express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and accuracy.

VIII. LIMITATION OF LIABILITY
To the fullest extent permitted by law, LUNIERE ATELIER shall not be liable for:
    •    Any direct, indirect, incidental, consequential, exemplary, or punitive damages;
    •    Loss of profits, data, or reputation;
    •    Any claims arising from use, inability to use, or reliance on Maison Materials;
    •    Actions or claims involving third-party content.
The sole remedy available to users is the cessation of Site access.

IX. INDEMNIFICATION
Users agree to defend, indemnify, and hold harmless LUNIERE ATELIER, its affiliates, directors, officers, employees, agents, and collaborators, against any claims, losses, liabilities, damages, or expenses (including attorneys’ fees) arising from:
    •    Unauthorized use of Maison Materials;
    •    Violation of these Terms;
    •    Harassment or infringement of Artists’ rights;
    •    Misrepresentation or breach of Site conduct rules.

X. COPYRIGHT ENFORCEMENT AND PROTECTION OF MAISON MATERIALS
The Maison asserts exclusive rights over all Maison Materials. Unauthorized reproduction, adaptation, transmission, public performance, or commercial exploitation of any Maison Materials constitutes direct violation of copyright lawand is strictly forbidden.
Enforcement Measures:
    0.    The Maison monitors, investigates, and reserves the right to take legal action against any infringement, including civil or criminal proceedings.
    0.    Unauthorized attempts to reproduce, transmit, or claim ownership of Maison Materials may result in injunctions, monetary damages, and recovery of legal fees.
    0.    Technical circumvention of protections or rights management is expressly prohibited.
    0.    Users are encouraged to report suspected violations to contact@luniereatelier.com . Reports must include sufficient details for identification and verification of the infringement.

XI. GOVERNING LAW, JURISDICTION, AND INTERNATIONAL CONSIDERATIONS
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.
• Users consent to the exclusive jurisdiction of the courts of the United States for all disputes arising under these Terms.
• For enforcement abroad, including other jurisdictions, the Maison may pursue legal remedies as necessary to protect its rights, Artists, and Maison Materials.

XII. AMENDMENTS AND CONTINUITY
    0.    The Maison reserves the unilateral right to revise or enhance these Terms at any time, for reasons including but not limited to: intellectual property protection, artist safety, legal compliance, and operational needs.
    0.    Revisions will be effective upon posting to the Site.
    0.    Continued use of the Site constitutes express acceptance of revised Terms.
    0.    Users are responsible for periodic review of the Terms to remain informed of updates.
